NotifyBulk ("the Platform", "we", "us") provides a cloud-based SMS and email marketing service that allows registered businesses ("User", "you") to send bulk and automated messages to their customers. By creating an account and using the Platform, you agree to be bound by these Terms & Conditions.
You must be at least 18 years old and acting on behalf of a legitimate business to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@notifybulk.com if you suspect unauthorized access.
You agree to use the Platform solely for lawful business communications. You must not use the Platform to:
You acknowledge that SMS messaging is subject to strict regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) in the United States. You are solely responsible for:
NotifyBulk is a technology platform and is not responsible for the content of messages sent by Users or for any regulatory violations arising from User campaigns.
To maintain carrier deliverability and comply with anti-spam regulations, SMS message templates may not contain:
http://, https://) or a www. prefix.domain.com/page).These restrictions exist because carrier networks automatically filter messages containing links and phone numbers that may be associated with phishing or spam activity.
The Platform uses an automated content moderation system powered by OpenAI to detect and block campaigns containing inappropriate content before they are delivered. Campaigns flagged by this system will not be sent and will be logged for review. NotifyBulk reserves the right to review flagged content and take action, including account suspension, if repeated violations are detected.
Access to the NotifyBulk API is subject to rate limits established per account. Limits are applied per minute and per hour for both SMS and email endpoints. Exceeding these limits will result in requests being temporarily rejected (HTTP 429). NotifyBulk reserves the right to adjust rate limits at any time based on platform load and plan type. Attempts to circumvent rate limits through multiple accounts or automated token rotation are prohibited and may result in account termination.
The Platform operates on a credit-based system. SMS and email credits are allocated per subscription plan. Credits are consumed upon successful message delivery. Failed deliveries due to invalid recipient data, carrier rejection, or content filtering are subject to the refund policy stated in your plan documentation. Credits are non-transferable and expire according to your plan terms. NotifyBulk is not responsible for message delivery failures caused by carrier networks, recipient settings, or content filtering.
Participation in the NotifyBulk referral program is optional. Referral credits are awarded only when a referred user subscribes to a paid plan. Credits resulting from free or $0 plans are not eligible for referral rewards. NotifyBulk reserves the right to modify or discontinue the referral program at any time.
NotifyBulk may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, generate excessive spam complaints, or cause harm to the Platform or its users. Upon termination, access to your account and any remaining credits will be revoked. You may cancel your account at any time from your billing settings.
To the maximum extent permitted by applicable law, NotifyBulk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform. NotifyBulk's total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid to NotifyBulk in the three (3) months preceding the event giving rise to the claim.
By using the Platform, you agree to our Privacy Policy. You are responsible for ensuring that the personal data of your recipients is collected and processed in accordance with applicable data protection laws. NotifyBulk processes your data and your recipients' contact information solely to deliver the service and does not sell personal data to third parties.
NotifyBulk reserves the right to update these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes via email or in-platform notification.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Utah. You waive any objection to the exercise of jurisdiction over you by such courts.
